TERMS AND CONDITIONS OF THE AUCTION: All property sold is subject to Bankruptcy Court Approval. This property is being sold as-is, where-is with no warranty being expressed or implied as to the physical condition, specific zoning or available permits by the Seller, Auction Company or its Agents. The Buyer will have to sign a copy of the OFFER TO PURCHASE agreement with R.N. Osherow, Trustee before bidding. A 10% earnest money deposit must be wired 48 hours after the auction ends. If buyer fails to deposit the 10% earnest money, the property will be sold to the backup bidder at the backup bid price. The property is offered with no contingencies for financing, so buyers should have financing in place prior to the auction with closing within 30 days of the date of the auction. All closing costs will be paid by the buyer. The Seller will not provide buyer with a survey. If buyer or buyer’s lender requires a survey it will be at the sole cost of the buyer.
